PEBAX- ARKEMA Competition Rules

ARTICLE 1
The Company ARKEMA France, headquartered at B06-090C – 420 rue d’Estienne d’Orves 92700 Colombes, France, and company-registered 319.632.790 RCS Nanterre, is organizing from April 20th to June 21st 2009 a free competition with no obligation to purchase, called « Pebax-Mizuno Contest 2009 », available exclusively via a dedicated section of the website http://www.pebaxpowered.com and open to all websurfers who log on to this website throughout the duration of the competition.
The Competition is governed by French law, and the prizes consist of 20 pairs of Mizuno Wave Rider 12 shoes per region (Europe, United States, Japan), i.e. 60 pairs of Mizuno Wave Rider 12 shoes in total.
ARTICLE 2
The Competition is open to anyone over the age of 18 excluding members of the organizing company (Arkema) and its partner, the company Mizuno, their respective subsidiaries, and their families.
ARTICLE 3
The terms and conditions for participation in the Competition are set out on the online form featured on the http://www.pebaxpowered.com website on which participants are required to register their name and contact details.
ARTICLE 4
Between April 20th and June 21st 2009 inclusive, entrants are required to answer 3 questions with 2 to 3 possible answers. Only one answer per question will be deemed correct.
Arkema will hold 1 draw with all correct answers received before June 21st 2009 inclusive, to pick all 60 winners for the 60 prizes on offer.
The Competition Rules are being held by the Etude de Maître Raphaëlle RENOUX, Huissiers de Justice associés, 160, cours du Médoc - 33000 Bordeaux.
All incomplete or unintelligible entry forms will be void.
Only one entry per person will be allowed (same name, same address).
ARTICLE 5
The prizes consist of 60 pairs of Mizuno Wave Rider 12 shoes retailing for € 94.80 (JPY 12,600.00) each.
ARTICLE 6
To enter this free Competition, simply answer the 3 questions featured on the site http://www.pebaxpowered.com from April 20th 2009.
ARTICLE 7
The 60 winners will be notified by email sent to the email address shown on their electronic entry form, as well as by post to their postal address.
In the absence of any reply within 60 days, the prizes will be forfeited and may no longer be claimed. A further draw will be held.
No prize (pairs of Mizuno Wave Rider 12 shoes) may be exchanged, substituted, or exchanged for cash.
ARTICLE 8
All correct answers will be entered in the draw on June 22nd 2009, to be held by Maître Raphaëlle RENOUX, Huissiers de Justice associés, in their offices at 160, cours du Médoc - 33000 Bordeaux.
ARTICLE 9
The prizes will be sent to the winners by Chronopost courier service to the address shown on their electronic entry forms within 1 month of the date on which the winners have provided the necessary information, in particular shoe size. Should the item be out of stock, a prize of an equivalent value will be offered from the Mizuno range.
ARTICLE 10
The companies ARKEMA and MIZUNO reserve the right to use the names and addresses of the winners for advertising or for public relations purposes, as part of any publicity on this operation; there will, however, be no compensation whatsoever, financial or otherwise, other than the competition prizes.
ARTICLE 11
Participants will have access to the Competition Rules before entering the Competition. By entering the Competition, entrants agree to be bound by these Rules. The organizing company reserves the right to cut short, extend or cancel the Competition in case of force majeure or if required by circumstances outside its control, without assuming any responsibility.
ARTICLE 12
The participants’ address will be taken as the address shown on their competition entry form. Winners may be requested by the competition organizers to provide proof of identity and address.
The companies ARKEMA and MIZUNO will retain the contact details of the winners/participants for future information or advertising on their products.
Winners and participants will, however, have the right to appeal, access or modify the data which concern them under the terms of French Law n°78-17 of January 6th 1978 regarding data protection, digital information and liberties. Winners and participants wishing to exercise this right will be required to contact ARKEMA in writing.
ARTICLE 13
The Competition Rules are being held by and are available on request from ARKEMA – External Communications – Pebax Internet Competition, 420 rue d’Estienne d’Orves 92700 Colombes.
Postage will be refunded on request at the current non-priority letter rate.
Participants may also apply in writing to ARKEMA – External Communications – Pebax Internet Competition, 420 rue d’Estienne d’Orves 92700 Colombes, for a refund of connection charges on a flat rate basis of a 3-minute connection, i.e. € 0.16 including taxes. They should include, with their application, their bank account details together with a bill from France Télécom or from another internet provider in support of their application within 7 days of the Competition’s closing date, with the postmark being taken as proof. Postal charges incurred by the participants relating to this application will be refunded at the current non-priority letter rate. Only one application per household will be considered (same name, same address).
ARTICLE 14
By entering the Competition, entrants agree to be bound by these Rules, its Annexes and Additions, as held by Maître Raphaëlle RENOUX, Huissiers de Justice associés - 160, cours du Médoc - 33000 Bordeaux.
